Potential Health Hazards of Genetically Engineered Foods

By Stephen Lendman
Global Research, February 15, 2014
Global Research 22 February 2008
Theme: Biotechnology and GMO, Science and Medicine

This article discusses the potential health risks of genetically engineered foods (GMOs). It draws on some previously used material because its importance bears repeating. It also cites three notable books and highlights one in particular – Jeffrey Smith’s “Genetic Roulette: The Documented Health Risks of Genetically Engineered Foods.” Detailed information from the book is featured below.
Genetically engineered foods saturate our diet today. In the US alone, over 80% of all processed foods contain them. Others include grains like rice, corn and wheat; legumes like soybeans and soy products; vegetable oils, soft drinks; salad dressings; vegetables and fruits; dairy products including eggs; meat, chicken, pork and other animal products; and even infant formula plus a vast array of hidden additives and ingredients in processed foods (like in tomato sauce, ice cream, margarine and peanut butter). Consumers don’t know what they’re eating because labeling is prohibited, yet the danger is clear. Independently conducted studies show the more of these foods we eat, the greater the potential harm to our health.
Today, consumers are kept in the dark and are part of an uncontrolled, unregulated mass human experiment the results of which are unknown. Yet, the risks are enormous, it will take years to learn them, and when we finally know it’ll be too late to reverse the damage if it’s proved conclusively that genetically engineered foods harm human health as growing numbers of independent experts believe. Once GM seeds are introduced to an area, the genie is out of the bottle for keeps. There is nothing known to science today to reverse the contamination already spread over two-thirds of arable US farmland and heading everywhere unless checked.
This is happening in spite of the risk because of what F. William Engdahl revealed in his powerfully important, well documented book titled “Seeds of Destruction: The Hidden Agenda of Genetic Manipulation.” It’s the diabolical story of how Washington and four Anglo-American agribusiness giants plan world domination by patenting animal and vegetable life forms to gain worldwide control of our food supply, make it all genetically engineered, and use it as a weapon to reward friends and punish enemies.
Today, consumers eat these foods daily without knowing the potential health risks. In 2003, Jeffrey Smith explained them in his book titled “Seeds of Deception.” He revealed that efforts to inform the public have been quashed, reliable science has been buried, and consider what happened to two distinguished scientists – UC Berkeley’s Ignacio Chapela and former Scotland Rowett Research Institute researcher and world’s leading lectins and plant genetic modification expert, Arpad Pusztai. They were vilified, hounded, and threatened for their research, and in the case of Pusztai, fired from his job for doing it.
He believed in the promise of GM foods, was commissioned to study them, and conducted the first ever independent one on them anywhere. Like other researchers since, he was shocked by his findings. Rats fed GM potatoes had smaller livers, hearts, testicles and brains, damaged immune systems, and showed structural changes in their white blood cells making them more vulnerable to infection and disease compared to other rats fed non-GMO potatoes. It got worse. Thymus and spleen damage showed up; enlarged tissues, including the pancreas and intestines; and there were cases of liver atrophy as well as significant proliferation of stomach and intestines cells that could be a sign of greater future risk of cancer. Equally alarming, results showed up after 10 days of testing, and they persisted after 110 days that’s the human equivalent of 10 years.
Later independent studies confirmed what Pusztai learned, and Smith published information on them in his 2007 book called “Genetic Roulette: The Documented Health Risks of Genetically Engineered Foods.” The book is encyclopedic in depth, an invaluable comprehensive source, and this article reviews some of the shocking data in it.
Compelling Evidence of Potential GMO Harm
In his introduction, Smith cites the US Food and Drug Administration’s (FDA) policy statement on GM food safety without a shred of evidence to back it. It supported GHW Bush’s Executive Order that GMOs are “substantially equivalent” to ordinary seeds and crops and need no government regulation. The agency said it was “not aware of any information showing that foods derived by these new methods differ from other foods in any meaningful or uniform way.” That single statement meant no safety studies are needed and “Ultimately, it is the food producer” that bears responsibility “for assuring safety.” As a consequence, foxes now guard our henhouse in a brave new dangerous world.
FDA policy opened the floodgates, and Smith put it this way: It “set the stage for the rapid deployment of the new technology,” allowed the seed industry to become “consolidated, millions of acres (to be) planted, hundreds of millions to be fed (these foods in spite of nations and consumers objecting, and) laws to be passed (to assure it).” The toll today is contaminated crops, billions of dollars lost, human health harmed, and it turns out the FDA lied.
The agency knew GM crops are “meaningfully different” because their technical experts told them so. As a result, they recommended long-term studies, including on humans, to test for possible allergies, toxins, new diseases and nutritional problems. Instead, politics trumped science, the White House ordered the FDA to promote GM crops, and a former Monsanto vice-president went to FDA to assure it.
Today, the industry is unregulated, and when companies say their foods are safe, their views are unquestioned. Further, Smith noted that policy makers in other countries trust FDA and wrongly assume their assessments are valid. They’re disproved when independent studies are matched against industry-run ones. The differences are startling. The former report adverse affects while the latter claim the opposite. It’s no secret why. Agribusiness giants allow nothing to interfere with profits, safety is off the table, and all negative information is quashed.
As a result, their studies are substandard, adverse findings are hidden, and they typically “fail to investigate the impacts of GM food on gut function, liver function, kidney function, the immune system, endocrine system, blood composition, allergic response, effects on the unborn, the potential to cause cancer, or impacts on gut bacteria.” In addition, industry-funded studies creatively avoid finding problems or conceal any uncovered. They cook the books by using older instead of younger more sensitive animals, keep sample sizes too low for statistical significance, dilute the GM component of feeds used, limit the duration of feeding trials, ignore animal deaths and sickness, and engage in other unscientific practices. It’s to assure people never learn of the potential harm from these foods, and Smith says they can do it because “They’ve got ‘bad science’ down to a science.”
The real kinds show GMOs produce “massive changes in the natural functioning of (a) plant’s DNA. Native genes can be mutated, deleted, permanently turned off or on….the inserted gene can become truncated, fragmented, mixed with other genes, inverted or multiplied, and the GM protein it produces may have unintended characteristics” that may be harmful.
GMOs also pose other health risks. When a transgene functions in a new cell, it may produce different proteins than the ones intended. They may be harmful, but there’s no way to know without scientific testing. Even if the protein is exactly the same, there are still problems. Consider corn varieties engineered to produce a pesticidal protein called Bt-toxin. Farmers use it in spray form, and companies falsely claim it’s harmless to humans. In fact, people exposed to the spray develop allergic-type symptoms, mice ingesting Bt had powerful immune responses and abnormal and excessive cell growth, and a growing number of human and livestock illnesses are linked to Bt crops.
Smith notes still another problem relating to inserted genes. Assuming they’re destroyed by our digestive system, as industry claims, is false. In fact, they may move from food into gut bacteria or internal organs, and consider the potential harm. If corn genes with Bt-toxin get into gut bacteria, our intestinal flora may become pesticide factories. There’s been no research done to prove if it’s true or false. Agribusiness giants aren’t looking, neither is FDA, consumers are left to play “Genetic Roulette,” and the few animal feeding studies done show the odds are against them.
Arpad Pusztai and other scientists were shocked at their results of animals fed GM foods. His results were cited above. Other independent studies showed stunted growth, impaired immune systems, bleeding stomachs, abnormal and potentially precancerous cell growth in the intestines, impaired blood cell development, misshaped cell structures in the liver, pancreas and testicles, altered gene expression and cell metabolism, liver and kidney lesions, partially atrophied livers, inflamed kidneys, less developed organs, reduced digestive enzymes, higher blood sugar, inflamed lung tissue, increased death rates and higher offspring mortality as well.
There’s more. Two dozen farmers reported their pigs and cows fed GM corn became sterile, 71 shepherds said 25% of their sheep fed Bt cotton plants died, and other reports showed the same effects on cows, chickens, water buffaloes and horses. After GM soy was introduced in the UK, allergies from the product skyrocketed by 50%, and in the US in the 1980s, a GM food supplement killed dozens and left five to ten thousand others sick or disabled.
Today, Monsanto is the world’s largest seed producer, and Smith notes how the company deals with reports like these. In response to the US Public Health Service concerning adverse reactions from its toxic PCBs, the company claims its experience “has been singularly free of difficulties.” That’s in spite of lawsuit-obtained records showing “this was part of a cover-up and denial that lasted decades” by a company with a long history of irresponsible behavior that includes “extensive bribery, highjacking of regulatory agencies, suppressing negative information about its products” and threatening journalists and scientists who dare report them. The company long ago proved it can’t be trusted with protecting human health.
In his book, “Seeds of Destruction,” Engdahl names four dominant agribusiness giants – Monsanto, DuPont, Dow Agrisciences and Syngenta in Switzerland from the merger of the agriculture divisions of Novartis and AstraZeneca. Smith calls these companies Ag biotech and names a fifth – Germany-based Bayer CropScience AG (division of Bayer AG) with its Environmental Science and BioScience headquarters in France.
Their business is to do the impossible and practically overnight – change the laws of nature and do them one better for profit. So far they haven’t independent because genetic engineering doesn’t work like natural breeding. It may or may not be a lot of things, but it isn’t sex, says Smith. Michael Antoniou, a molecular geneticist involved in human gene therapy, explains that genetic modification “technically and conceptually bears no resemblance to natural breeding.” The reproduction process works by both parents contributing thousands of genes to the offspring. They, in turn, get sorted naturally, and plant breeders have successfully worked this way for thousands of years.
Genetic manipulation is different and so far fraught with danger. It works by forcibly inserting a single gene from a species’ DNA into another unnaturally. Smith puts it this way: “A pig can mate with a pig and a tomato can mate with a tomato. But this is no way that a pig can mate with a tomato and vice versa.” The process transfers genes across natural barriers that “separated species over millions of years of evolution” and managed to work. The biotech industry now wants us to believe it can do nature one better, and that genetic engineering is just an extension or superior alternative to natural breeding. It’s unproved, indefensible pseudoscience mumbo jumbo, and that’s the problem.
Biologist David Schubert explains that industry claims are “not only scientifically incorrect but exceptionally deceptive….to make the GE process sound similar to conventional plant breeding.” It a smoke screen to hide the fact that what happens in laboratories can’t duplicate nature, at least not up to now. Genetic engineering involves combining genes that never before existed together, the process defies natural breeding proved safe over thousands of years, and there’s no way to assure the result won’t be a deadly unrecallable Andromeda Strain, no longer the world of science fiction.
The industry pooh-pooh’s the suggestion of potential harm, and unscientifically claims millions of people in the US and worldwide have eaten GM food for a decade, and no one got sick. Smith’s reply: How can we know as “GM foods might already be contributing to serious health problems, but since no one is monitoring for this, it could take decades” to find out. By then, it will be too late and some industry critics argue it already may be or dangerously close.
Today, most existing diseases have no effective surveillance systems in place. If GM foods create new ones, that potentially compounds the problem manyfold. Consider HIV/AIDS. It went unnoticed for decades and when identified, many thousands worldwide were infected or had died.
Then there’s the problem of linkage. In the US and many countries, GM foods are unlabeled so it’s impossible tracing illness and diseases to specific substances ingested even if thousands of people are affected. It can plausibly be blamed on anything, especially when governments and regulatory agencies support industry claims of reliability and safety.
It’s rare that problems like the L-Tryptophan epidemic of the late 1980s are identified, but when it was thousands were already harmed. L-Tryptophan is a natural amino acid constituent of most proteins and for years was produced by many companies including Showa Denko in Japan. The company then got greedy, saw a way to increase profits from a product designed to induce sleep naturally, and gene-spliced a bacterium into the natural product to do it. The result was many dozens dead, over 1500 crippled, and up to 10,000 afflicted with a blood disorder from a new incurable disease called Eosinophilia Myalgia Syndrome or EMS.
It’s a painful, multi-system disease that causes permanent scarring and fibrosis to nerve and muscle tissues, continuing inflammation, and a permanent change in a person’s immune system. It cost the company two billion dollars to settle claims. Hundreds have since died, in all likelihood from contracting EMS.
This is the known toll from a single product. Consider the potential harm with Ag biotech wanting all foods to be unlabeled GMOs worldwide and governments unable to balk because WTO Agreement on Agriculture (AoA) and Trade Related Intellectual Property Rights (TRIPS) rules deny them. They’re also prevented under WTO’s Sanitary and Phytosanitary Agreement (SPS). It states that national laws banning GMO products are “unfair trade practices” even when they endanger human health. Other WTO rules also apply – called “Technical Barriers to Trade.” They prohibit GMO labeling so consumers don’t know what they’re eating and can’t avoid these potentially hazardous foods.
The 1996 Biosafety Protocol was drafted to prevent this problem, and it should be in place to do it. Public safety, however, was ambushed by Washington, the FDA and the agribusiness lobby. It sabotaged talks and insisted biosafety measures be subordinate to WTO trade rules that apply regardless of other considerations, including public health and safety. The path is thus cleared for the unrestricted spread of GMO seeds and foods worldwide unless a way is found to stop it.
Independent Animal Studies Showing GMO Harm
Rats fed genetically engineered Calgene Flavr-Savr tomatoes (developed to look fresh for weeks) for 28 days got bleeding stomachs (stomach lesions) and seven died and were replaced in the study.
Rats fed Monsanto 863 Bt corn for 90 days developed multiple reactions typically found in response to allergies, infections, toxins, diseases like cancer, anemia and blood pressure problems. Their blood cells, livers and kidneys showed significant changes indicative of disease.
Mice fed either GM potatoes engineered to produce Bt- toxin or natural potatoes containing the toxin had intestinal damage. Both varieties created abnormal and excessive cell growth in the lower intestine. The equivalent human damage might cause incontinence or flu-like symptoms and could be pre-cancerous. The study disproved the contention that digestion destroys Bt-toxin and is not biologically active in mammals.
Workers in India handling Bt cotton while picking, loading, weighing and separating the fiber from seeds developed allergies. They began with “mild to severe itching,” then redness and swelling, followed by skin eruptions. These symptoms affected their skin, eyes (got red and swollen with excessive tearing) and upper respiratory tract causing nasal discharge and sneezing. In some cases, hospitalization was required. At one cotton gin factory, workers take antihistamines daily.
Sheep grazing on Bt cotton developed “unusual systems” before dying “mysteriously.” Reports from four Indian villages revealed 25% of them died within a week. Post mortems indicated a toxic reaction. The study raises questions about cottonseed oil safety and human health for people who eat meat from animals fed GM cotton. It’s crucial to understand that what animals eat, so do people.
Nearly all 100 Filipinos living adjacent to a Bt corn field became ill. Their symptoms appeared when the crop was producing airborne pollen and was apparently inhaled. Doing it produced headaches, dizziness, extreme stomach pain, vomiting, chest pains, fever, and allergies plus respiratory, intestinal and skin reactions. Blood tests conducted on 39 victims showed an antibody response to Bt-toxin suggesting it was the cause. Four other villages experienced the same problems that also resulted in several animal deaths.
Iowa farmers reported a conception rate drop of from 80% to 20% among sows (female pigs) fed GM corn. Most animals also had false pregnancies, some delivered bags of water and others stopped menstruating. Male pigs were also affected as well as cows and bulls. They became sterile and all were fed GM corn.
German farmer Gottfried Glockner grew GM corn and fed it to his cows. Twelve subsequently died from the Bt 176 variety, and other cows had to be destroyed due to a “mysterious” illness. The corn plots were field trials for Ag biotech giant Syngenta that later took the product off the market with no admission of fault.
Mice fed Monsanto Roundup Ready soybeans developed significant liver cell changes indicating a dramatic general metabolism increase. Symptoms included irregularly shaped nuclei and nucleoli, and an increased number of nuclear pores and other changes. It’s thought this resulted from exposure to a toxin, and most symptoms disappeared when Roundup Ready was removed from the diet.
Mice fed Roundup Ready had pancreas problems, heavier livers and unexplained testicular cell changes. The Monsanto product also produced cell metabolism changes in rabbit organs, and most offspring of rats on this diet died within three weeks.
The death rate for chickens fed GM Liberty Link corn for 42 days doubled. They also experienced less weight gain, and their food intake was erratic.
In the mid-1990s, Australian scientists discovered that GM peas generated an allergic-type inflammatory response in mice in contrast to the natural protein that had no adverse effect. Commercialization of the product was cancelled because of fear humans might have the same reaction.
When given a choice, animals avoid GM foods. This was learned by observing a flock of geese that annually visit an Illinois pond and feed on soybeans from an adjacent farm. After half the acreage had GM crops, the geese ate only from the non-GMO side. Another observation showed 40 deer ate organic soybeans from one field but shunned the GMO kind across the road. The same thing happened with GM corn.
Inserting foreign or transgenes is called insertional mutagenesis or insertion mutation. When done, it usually disrupts DNA at the insertion site and affects gene functioning overall by scrambling, deleting or relocating the genetic code near the insertion site.
The process of creating a GM plant requires scientists first to isolate and grow plant cells in the laboratory using a tissue culture process. The problem is when it’s done it can create hundreds or thousands of DNA mutations throughout the genome. Changing a single base pair may be harmful. However, widespread genome changes compound the potential problem manyfold.
Promoters are used in GM crops as switches to turn on the foreign gene. When done, the process may accidently switch on other natural plant genes permanently. The result may be to overproduce an allergen, toxin, carcinogen, antinutrient, enzymes that stimulate or inhibit hormone production, RNA that silences genes, or changes that affect fetal development. They may also produce regulators that block other genes and/or switch on a dormant virus that may cause great harm. In addition, evidence suggests the promoter may create genetic instability and mutations that can result in the breakup and recombination of the gene sequence.
Plants naturally produce thousands of chemicals to enhance health and protect against disease. However, changing plant protein may alter these chemicals, increase plant toxins and/or reduce its phytonutrients. For example, GM soybeans produce less cancer-fighting isoflavones. Overall, studies show genetic modification produces unintended changes in nutrients, toxins, allergens and small molecule metabolism products.
To create a GM soybean with a more complete protein balance, Pioneer Hi-Bred inserted a Brazil nut gene. By doing it, an allergenic protein was introduced affecting people allergic to Brazil nuts. When tests confirmed this, the project was cancelled. GM proteins in other crops like corn and papaya may also be allergenic. The same problem exists for other crops like Bt corn, and evidence shows allergies skyrocketed after GM crops were introduced.
Another study of Monsanto’s high-lysine corn showed it contained toxins and other potentially harmful substances that may retard growth. If consumed in large amounts, it may also adversely affect human health. In addition, when this product is cooked, it may produce toxins associated with Alzheimer’s, diabetes, allergies, kidney disease, cancer and aging symptoms.
Disease-resistant crops like zucchini, squash and Hawaiian papaya may promote human viruses and other diseases, and eating these products may suppress the body’s natural defense against viral infections.
Protein structural aspects in GM crops may be altered in unforeseen ways. They may be misfolded or have added molecules. During insertion, transgenes may become truncated, rearranged or interspersed with other DNA pieces with unknown harmful effects. Transgenes may also be unstable and spontaneously rearrange over time, again with unpredictable consequences. In addition, they may create more than one protein from a process called alternative splicing. Environmental factors, weather, natural and man-made substances and genetic disposition of a plant further complicate things and pose risks. They’re introduced as well because genetic engineering disrupts complex DNA relationships.
Contrary to industry claims, studies show transgenes aren’t destroyed digestively in humans or animals. Foreign DNA can wander, survive in the gastro-intestinal tract, and be transported by blood to internal organs. This raises the risk that transgenes may transfer to gut bacteria, proliferate over time, and get into cells DNA, possibly causing chronic diseases. A single human feeding study confirmed that genes, in fact, transferred from GM soy into the DNA gut bacteria of three of seven test subjects.
Antibiotic Resister Marker (ARM) genes are attached to transgenes prior to insertion and allow cells to survive antibiotic applications. If ARM genes transfer to pathogenic gut or mouth bacteria, they potentially can cause antibiotic-resistant super-diseases. The proliferation of GM crops increases the possibility. The CaMV promoter in nearly all GMOs can also transfer and may switch on random genes or viruses that produce toxins, allergens or carcinogens as well as create genetic instability.
GM crops interact with their environment and are part of a complex ecosystem that includes our food. These crops may increase environmental and other toxins that may accumulate throughout the food chain. Crops genetically engineered to be glufosinate (herbicide)resistant may produce intestinal herbicide with known toxic effects. If transference to gut bacteria occurs, greater problems may result.
Repeated use of seeds like Monsanto’s Roundup Ready soybeans results in vicious new super-weeds that need far greater amounts of stronger herbicides to combat. Their toxic residues remain in crops that humans and animals then eat. Even small amounts of these toxins may be endocrine disruptors that can affect human reproduction adversely. Evidence exists that GM crops accumulate toxins or concentrate them in milk or animals fed GM feed. Disease-resistant crops may also produce new plant viruses that affect humans.
All type GM foods, not just crops, carry these risks. Milk, for example, from cows injected with Monsanto’s bovine growth hormone (rbGH), has much higher levels of the hormone IGF-1 that risks breast, prostate, colon, lung and other cancers. The milk also has lower nutritional value. GM food additives also pose health risks, and their use has proliferated in processed foods.
Potential harm to adults is magnified for children. Another concern is that pregnant mothers eating GM foods may endanger their offspring by harming normal fetal development and altering gene expression that’s then passed to future generations. Children are also more endangered than adults, especially those drinking substantial amounts of rbGH-treated milk.
Conclusion
The above information is largely drawn from Smith’s “Genetic Roulette.” The data is startling and confirms a clear conclusion. The proliferation of untested, unregulated GM foods in the span of a decade is more a leap of faith than reliable science. Microbiologist Richard Lacey captures the risk stating: “it is virtually impossible to even conceive of a testing procedure to assess the health effects of (GM) foods when introduced into the food chain, nor is there any valid nutritional or public interest reason for their introduction.” Other scientists worldwide agree that GM foods entered the market long before science could evaluate their safety and benefits. They want a halt to this dangerous experiment that needs decades of rigorous research and testing before we can know.
Unchecked and unregulated, human health and safety are at risk because once GMOs enter the food chain, the genie is out of the bottle for keeps. Thankfully, resistance is growing worldwide, many millions are opposed, but reversing the tide won’t be easy. Washington and Ag biotech are on a roll with big unstated aims – total control of our food, making it all genetically engineered, and scheming to use it as a weapon to reward friends and punish enemies.
Smith is hopeful that people will prevail over profits. Hopefully he’s right because human health and safety must never be compromised. Resistance already halted the introduction of new crop varieties, and Smith believes that with enough momentum existing ones may end up withdrawn. He cites an example he calls a “Shift away from GM foods in the United States” in 2007. Leading it is an initiative launched last spring to remove GM ingredients from the entire natural food sector. It’s led by a coalition of natural food products producers, distributors and retailers along with the Institute for Responsible Technology (IRT). It’s called the Campaign for Healthier Eating in America, and its aims are big – to educate consumers about GM food risks and promote healthy alternatives through shopping guides.
A Pew survey reported that 29% of Americans, representing 87 million people, strongly oppose these foods and believe they’re unsafe. That’s a respectable start if backed up with efforts to avoid them, and more information how is at ResponsibleTechnology.org. Jeffrey Smith founded IRT in 2003 “to promote the responsible use of technology and stop GM foods and crops through both grassroots and national strategies.” It seeks safe alternatives and aims to “ban the genetic engineering of our food supply and all outdoor releases of (GM) organisms, at least until (or unless scientific opinion) believes such products are safe and appropriate based on independent and reliable data.”
IRT urges consumers to become educated about the risks, mobilize to combat them and act in our mutual self-interest. It’s beginning to happen, and Smith believes “there is an excellent chance that food manufacturers will abandon GM foods in the near future” if a public groundswell demands it. He ends his book saying: “Although GMOs present one of the greatest dangers, with informed, motivated people, it is one of the easiest global issues to solve.” Hopefully he’s right.

Drug Smuggling DEA calls Marijuana Legalization ‘Reckless and Irresponsible’

Updated 01/16/2014
The Drug Enforcement Administration’s chief of operations pleaded with lawmakers during a Senate hearing Wednesday, warning over the alleged dangers of marijuana legalization at the state level.

Image: DEA Drug Money (U.S. Open Borders)
“It scares us,” James L. Capra said according to the Washington Post. “Every part of the world where this has been tried, it has failed time and time again.”
Only one day after court documents revealed the DEA to be smuggling billions in drugs with Mexico’s notorious Sinaloa cartel, backing up a 2011 report by the El Paso Times, the federal agency seemed desperate to keep its blood money flowing uninterrupted, calling the growing legalization movement “reckless and irresponsible.”
“This is a bad experiment,” Capra said. “It’s going to cost us in terms of social costs.”
While the social costs are to be debated, it seems unlikely the DEA is concerned over the social cost of incarcerating millions of Americans for purchasing drugs the agency itself helped ship into the country.
Speaking specifically on Colorado, which recently legalized recreational use of marijuana, Capra claimed the agency was dismayed at the state’s decision.
“There are more dispensaries in Denver than there are Starbucks,” Capra said. “The idea somehow people in our country have that this is somehow good for us as a nation is wrong. It’s a bad thing.”
Multiple federal agencies drunk on billions in taxpayer money are in a panic as the general public begins questioning the drug trade’s real source. Attorney General Eric Holder’s recent refusal to prosecute HSBC, a bank caught laundering billions in drug money for Mexican cartels, dealt a major blow to the federal government’s credibility regarding the drug war.
Several years prior in 2011, banking giant Wachovia received no criminal charges after they were found to have laundered 378.6 billion in drug money for the Sinaloa cartel as well.
Incredibly, as cartel money laundering banks are protected by the federal government, the DEA has threatened those same banks with legal action if they store cash for small-time legal marijuana businesses in Washington and Colorado.
Given the DEA’s access to vast data from the NSA, many now question how the agency has not been able to stop such major drug groups. As many have said for years, the DEA at the highest level is nothing more than a smuggling and protection agency for cartels that work with major banks. Unfortunately, the federal government’s relationship with dangerous cartels goes much further than simple protection.
High-ranking Sinaloa member Jesus Vicente Zambada-Niebla recently admitted that the cartel had received weapons from the United States government for years under Operation Fast and Furious. While the Obama administration claims the operation was to track guns into Mexico, Niebla revealed the weapons to be for war with rival cartels.
Even more ironic, Wednesday’s Senate hearing was focused on drug cultivation in Afghanistan, where the arrival of US troops in 2001 has lead to record level opium production.
In fact, a 2009 report by the New York Times revealed one of Afghanistan’s biggest drug kingpins, the brother of Afghanistan’s president, to be on the CIA’s payroll.
The United States involvement in Afghanistan’s drug trade became so obvious that several news groups including ABC and FOX ran reports admitting that U.S. troops were ordered to help grow opium, though attempting to paint the practice as necessary.
While there is likely countless well-meaning DEA agents across the country, the bloodshed, hypocrisy and outright treasonous activity by the agency has few taking them serious.

Most Europeans Download and Stream Pirated Movies

  • By Ernesto
  • on February 14, 2014
Breaking
Nearly 70% of all Europeans download or stream films for free, a new study from the European Commission reveals. The high costs of legal alternatives such as movie tickets and DVDs are the main justification, with release lags and limited availability also among the top reasons.
europe-flagThe European Commission has released a new report on the film viewing habits of Europeans this week.
The report, titled “A profile of current and future audiovisual audience”, draws its conclusions based on a survey of 4,608 respondents between the ages of 4 and 50 scattered across Europe. The participants were taken from a representative sample of ten different countries including France, Germany and the UK.
One of the main findings is that up to 97% percent of all Europeans are film viewers, but that the majority don’t pay for the films they watch over the Internet.
“Nearly 70% of Europeans download or stream films for free, whether legally or illegally,” the European Commission reports.
The study does not distinguish between legal and illegal downloads, but half of all respondents said they downloaded or streamed films because cinema tickets and DVDs are too expensive. This suggests that the films they watch come from “pirate” sources.
More than two-third (68%) of film viewers said they downloaded movies without paying, and half of this group did so on a weekly basis. Streaming free movies is slightly less popular with 56% of the total, but it’s still something half of the population has experience with.
Downloading and streaming is most common among Europeans in the 16-25 age group. In addition, there is a small difference between men and women, with the former downloading and streaming slightly more.
One of the main questions is why so many people prefer free copies over paid alternatives. It may come as no surprise that price is an important factor here.
The chart below shows that the price of cinema tickets, video on demand services and DVDs is a key motivation. Half of all people say they prefer free films because the legal alternatives are too expensive.
The fact that some films are not available yet also plays an important role, and is mentioned by 30% of the respondents.
Why people pirate
europe-whypirate
The report also offers some further insight into regional differences in motivations. For example, the high price of legal films is mentioned by only 39% of Romanians, but by 64% of the French.
A lack of legal alternatives is often mentioned as a key motivation in Romania, Croatia and Poland, with around 35% in these countries. In France, the UK and Lithuania, availability was least mentioned with little over 20%.
According to the European Commission these high download and streaming numbers are no surprise, and it suggests that the film industry itself holds the key to lowering high piracy rates.
“The study finds that this is not surprising because, while the public takes a lot of interest in films as a whole, the nearest cinema is often some distance from them and the choice on screen is frequently rather limited,” the European Commission writes.
“It suggests that the European film industry can increase revenues by exploiting different types of profit-making online platforms to increase the availability of films and reach new audiences,” the Commission notes.
While the report signals some key trends, the movie industry is likely to disagree with the conclusion that it’s up to them to make a change.
Instead, Hollywood is likely interpret the findings as an affirmation that pirates are cheapskates out to save money, and therefore tougher anti-piracy measures are required.

Creepy New Google Tool That Allows You to Track a Key Metric When You Send Someone an Email…Without Their Knowledge

February 13th, 2014
(The Blaze) Forget the NSA: Google has enabled a level of internet spying, and it’s aimed at your e-mail inbox.
A Google Chrome extension dubbed Streak allows the user to see when e-mails are viewed by the recipient — without their knowledge.
The Streak website boasts the Gmail tracking capability (Image via Streak.com)

In other words, when installed by someone who sends you an eamil, Streak allows that person to see that you have opened their email without responding.
“Streak email tracking shows the status of all your tracked emails right in your inbox. You’ll see a green or gray ‘eye’ icon right next to any email in any inbox list telling you whether the email is being read or not,” reads the Streak website.
The Chrome extension reveals a green eyeball when the recipient has viewed the e-mail (Image via HuffPost).
The Chrome extension reveals a green eyeball when the recipient has viewed the e-mail (Image via HuffPost).
This might sound a lot like the function in Microsoft Outlook where a sender can ask for a “read receipt,” but according to Huffington Post, an email recipient doesn’t have to have the plugin installed in order for the sender to be notified that it was opened. The recipient won’t get any notification that their e-mail activity is being tracked.
It’s all very secretive.
Google has restricted other extensions in the past, such as local extensions in Chrome 33 for Windows and states that extension developers do have to follow a certain set of rules for the company to retain the extension. But Google relies on users to report back when an extension may – for example – links to “invasions of personal privacy or violations of the right of publicity.”
Streak is an independent company but with Google’s (at least passive) acceptance of the extension, the millions of Gmail users may be subject to the e-mail spying without ever agreeing to it.
Streak is a San Francisco based company which pitches the extension as a Customer Relations Management tool. “Streak was born out of the frustration of constantly having to switch between our inbox (where we do our work) and separate systems. Our goal is to take the work out of managing the processes you do everyday,” the Streak site states.
If Google Chrome users don’t like the idea of an extension spying on them unknowingly, they can give Google feedback by accessing the Streak page in the Chrome Web Store, click “details,” then, “send feedback.”

The Road to Superintelligence

In the 21st century, we are walking an important road. Our species is alone on this road and it has one destination: super-intelligence.
The most forward-thinking visionaries of our species were able to get a vague glimpse of this destination in the early 20th century. Paleontologist Pierre Teilhard de Chardin called this destination Omega Point. Mathematician Stanislaw Ulam called it "singularity":
One conversation on the ever accelerating progress of technology and changes in the mode of human life, which gives the appearance some essential singularity in the history of the race beyond which human affairs, as we know them, could not continue.
For thinkers like Chardin, this vision was spiritual and religious; God using evolution to pull our species closer to our destiny. For others, this vision was a fiercely secular and naturalistic technological utopia designed on scientific principles alone. The rapture for the nerds.
Today the philosophical debates of this vision have become more varied, but also more focused on model building and scientific prediction. The closer we get to our destination, the clearer we can see this world. In the early 20th century Chardin could only generalize about its features. In The Phenomenon of Man he described the Omega Point as "super-personalized" and "infinitely enriched".
It's hard to make real sense of what this means.
In contrast, today we can define the specific mechanisms that could realize a new world. We can actually see the singularity. We can actually touch it in laboratories around the world. Sometimes, we actually experience it in the real world of 2014. Modern theorists can describe it so well that it becomes real to the mind, making our present world seem hopelessly barbaric and painfully primitive. Even embarrassing.
One of the best descriptors of our potential future world was explored in a recent paper by cyberneticist Francis Heylighen titled: Return to Eden? Promises and Perils on the Road to Superintelligence.
Here I summarize the main technological mechanisms as described by Heylighen. I hope you will quickly realize the point of this exercise. In 2014, we live in a world with global brain technology. We live in a world where the consequences of our technological actions demonstrate that the possibilities of utopia come dangerously close to the possibilities of destruction. For example, drones can give us an automated distributed network with the ability to give anyone, anything they want, in a negligible amount of time and for negligible cost. Or... drones could be used to kill children in the developing world.
So far we've chosen the peril first, and planned for the promises second. With the technology yet to come, we must do better. We must prudently walk this road towards the promises, while avoiding the perils in their entirety.
Promise #1: Omniscience
Important Mechanisms:
  • Semantic web
  • Artificial intelligence (AI)
  • Massively Online Open Courses (MOOCs)
Global brain technologies give us the possibility to have the entirety of humanity interacting with omniscient knowledge bases. We are building computers to learn and communicate with humans in a personalized way. The more stored data we have to play with, the better we can design technologies to harness these data. Every single individual, from birth-to-death, can interact with a system that knows what they know, and knows what they need to know. Every individual can have a omniscient personal assistant to guide them through life and help direct them towards their desired goals. The omniscient knowledge base may even be able to recognize an individual's desired goals better than the individual, and make suggestions for future contemplation.
Promise #2: Omnipresence
Important mechanisms:
  • Internet of things (IoT)
  • Wearable/Internal computing
  • Cloud computing
We have a whole host of emerging technology to enable practical omnipresence. As we start the construction of a planet with *everything* connected to the internet, we take steps towards turning humanity into a *single-information-processing-unit*. This is the essence of global brain. Wirelessly communicating smart-technology should be able to immediately recognize any perturbation within our system, whether that be a fire, a murder, a transportation disaster and deploy the necessary mechanisms to resolve the situation or prevent it from ever happening in the first place. This grid should also allow for the efficient regulation of our entire transportation and energy grids, eliminating any physical friction so common within industrial transportation and energy grids.
Promise 3: Omnipotence
Important mechanisms:
  • Robotics
  • Nano-assemblers (3D/4D printing)
  • Internet of things (IoT)
Our present-level of abundance has almost everything to do with industry. Today, we are building the industrial internet, and this will transform production in ways that should give us practical omnipotence. We should be able to manufacture anything we want, for negligible cost, right from our own homes, within a negligible amount of time. This will transform production and consumption of all physical objects (e.g., food, organs, homes, vehicles) in a similar way to how digital technologies have transformed books, movies, and music in the past 20 years. In the global brain, anyone can be Henry Ford.
Promise 4: Omnibenevolence
Important mechanisms:
  • Higher education
  • Abundance
  • Increased connectivity
This is the hardest to justify with mechanisms. We need extrapolated trends, correlations, and natural philosophy to help us justify the assertion that practical omnibenevolence is achievable in the global brain. From what we can tell, the better educated people are, the greater their collective wealth, and the more they know about other peoples and cultures, the less violent and competitive they become. In a world of abundant education, resources, and hyper-connectivity, we should see a system emerge that is built on cooperation and abundance, as opposed to zero-sum competition and scarcity. Global brain should be the end of murder, war, slavery, prejudice, suppression, dictatorship, corruption. We should see a flourishing of human potential and justice.
This Road has Perils
This is not an easy road to walk. Super-intelligence is within our grasp. Temporally speaking, we're closer than most realize. The last few metaphorical kilometers may be the most difficult, or they may be surprisingly easy. No one really knows. But we do know that emergent technology can theoretically be used for global horrors, just as they can be used for global paradise. From my perspective the road can't be avoided, as evolution can't be stopped. But there is no way of knowing with 100% certainty whether we will successfully make the journey. It will take intelligent decision-making from our most powerful institutions. That takes evidence-based distributed decision-making, as opposed to ideology-driven centralized decision-making. They must be willing to make this change now. And yet I fear they won't. Maybe technology will re-structure them for us, or maybe we must actively change them ourselves. Maybe a combination of both approaches is the key. We do see signs of hope.
Whatever happens, the global brain is coming. The technology to build a global brain will come whether our institutions change or not. The problem then morphs into something a little more interesting: technology can build the global brain, but its up to us to build the global village.

Mystery Babylon And It’s Surveillance Will Spy On Everyone! Obama Says No Nation Avoids US Spying

February 12th, 2014

(RT) Ally or not, the US does not have an agreement with any country that would prevent espionage in light of national security concerns, President Obama said on Tuesday, prior to an official state dinner with a European head of state.
During a joint press conference with French President Francois Hollande, Obama was asked whether his selection of France for the first state visit of his second term as president signalled a post-spying agreement with America’s European ally. Through documents supplied by former National Security Agency contractor Edward Snowden, it was revealed that the NSA spied on French citizens and the internal communications of France’s foreign ministry and diplomats.

“There’s no country where we have a no-spy agreement,” Obama answered.
The US has long worked on global surveillance operations in conjunction with the other members of the so-called “Five Eyes” contingency: Australia, Canada, New Zealand, and the United Kingdom. Yet even the Five Eyes countries have not committed to avoid spying on one another.
Obama went on to highlight the changes he has ordered US agencies to make regarding direct surveillance of foreign leaders.
In announcing those changes in January, Obama said that the US is the “world’s only superpower” and must continue to conduct operations allies are not able to accomplish on their own.
“We will not apologize simply because our services may be more effective,” he said, “but heads of state and governments with whom we work closely . . . should feel confident that we are treating them as real partners.”

The US government “will continue to gather information about the intentions” of foreign governments, Obama said. Yet he also promised the NSA “will not monitor the communications of heads of state”atop the ranks of allied partners unless there are compelling national security purposes at stake.
Section 702 of the Foreign Intelligence Surveillance Act would be subject to reform as well, Obama announced, allowing the US to intercept the communications of overseas targets with important information without putting as many Americans and foreign persons incidentally targeted under the looking glass.
Speaking after Obama on Tuesday, Hollande said the two nations had put the controversy behind them, though he said foreign citizens’ privacy must be respected on some level.
“Mutual trust must be based on respect for each other’s country, but also based on the protection of private life, of personal data,” Hollande said.
There has been no indication to date that Hollande was the target of any NSA spying.
“Following the revelations that appeared due to Snowden, we clarified things, Mr. Obama and myself, we clarified things. And then this was in the past,” Hollande added. “Mutual trust has been restored.”
Hollande’s restored faith in the Franco-American alliance comes just in time for Tuesday night’s state dinner at the White House. Included on the guest list for Tuesday’s banquet honoring Hollande is NSA Director Keith Alexander.

Look In the Mirror America, This Is What We Have Become. Face the facts America and then we can change.

February 14th, 2014
(The Common Sense Show) As a child, I grew up being told that America is the best place to live in the world. I used to believe that until I turned off my television and opened my eyes. In fact, if the truth be known, our country is on the way to being a third world country. We are not a third country solely because of economics. We are a mere shadow of what we once were because we have allowed ourselves to become fact, dumb and incredibly miserable.
enslaved mind 1
Of course, if you provide an honest State of the Union, your fellow countrymen are likely to say something like “America, love or leave it.” Or, the more vulgar among us may sarcastically tell we naysayers to  “Not let the door hit you on the backside on the way out!” The dumbed down sheep in this country, courtesy of the corporate controlled media, come well well-equipped to defend the dysfunctional status quo with a plethora of pre-conditioned axioms which are designed to spur feelings of national pride and patriotism. To this day, the American public is brainwashed to accept the following axioms:
“It’s as sound as a dollar.” “American is the land of opportunity”. “Made in America”.  ”Americans are the envy of the world”.   “They hate us because of our freedoms”.
Look around the streets of America. Who could hate America because of “our freedoms”? Do we really think that the world of jealous of America because anyone of us can be snatched off of the street without any due process under the NDAA? Does the world hate us because Americans have so much freedom that we can be conscripted into a civilian army, against our will, and at any age under Executive Order 13603? At least in most totalitarian states, the citizens at least know the score. They know they live in a fascist police state. In America, we have become so desensitized and dumbed down, that many of countrymen couldn’t find the toilet without a GPS.

Americans Are Now Domesticated

The facts are clear, America is a nation in an undeniable state of  free fall. Of course, the establishment media will never give you the entire picture on how bleak of a future most of our children are looking at. For when we ask the question as to what nation is the most miserable, among, modern nations, the unquestionable answer to that question is the United States. The undeniable conclusion is the America has become fat, dumb but not very happy.

Who Is the Most Obese Nation On the Earth

America is undoubtedly the fattest nation on the planet. When one looks at the leanest nations in the world, it is interesting to note that most of these nations have mandatory GMO labeling laws and several of the nations do not allow GMO’s at all. Of course, we have allowed ourselves to become victims of our unhealthy food supply.

Tumors in rats caused by GMO food consumption
Certainly, our skyrocketing cancer rates (USA #1), our diabetes rates (USA #1) and our heart attack rates (USA #1 ) are closely correlated to the astronomical obesity rates. With these kinds of numbers, it is certainly easy to understand why so many in the Patriot movement accuse the globalists of deliberately poisoning and sabotaging the health of the general population. These dramatic shifts in America’s health status did not just arrive out of thin air. The causes must be environmental. My vote, based upon foreign lab studies falls squarely on the unregulated and unlabeled GMO foods that we eat. GMO foods and the chemtrails, the fluoride in the water and vaccines constitute a very effective soft kill program.

Living the Good, but Not Long Life In America

Out of 222 countries, the United States ranks 51st in life expectancy. Yet, America spends far more on pharmaceuticals than any other nation. We spend almost 18% of GDP on health care, almost double the next nation. Yet, people in Guam live longer than we do in the United States. Cubans have a lower infant mortality rate. For all of the technology and all of the money we spend on health care, these are unacceptable statistics. Again, it is difficult to not conclude that there is a decided depopulation agenda which is designed to shorten the life span of Americans given these variables.

Dumbed Down America

Education is supposed to be the great equalizer. Innovation and creativity, derived from education, compromises the well-spring of scientific development. America is 17th in the world in reading, 31st in science and 23rd in math.

Our military defense is predicated on technological innovation. One look at the statistics, is cause for grave concern over our national security, not to mention the standard of living for all Americans.

The above fact, constitutes are most significant long range national security threat. In less than a generation, it is unlikely that America will possess the most technological advanced weapon systems on the planet. This fact alone, make the US vulnerable to invasion and occupation.

Americans Are Becoming An Increasingly Miserable People

Unfortunately for Americans, people in Costa Rica and Panama are happier than Americans. Forty percent of Americans are struggling as compared to 35% of Costa Ricans and 39% Panamanians. Let me say this again, if you are an American, 40% of our countrymen are struggling to meet the basic essentials of life.
If I hear that we are so lucky to be Americans one more time, I think I am going to become nauseated. In the top 20 happiest nations in the world, only Mexico (5%) has more of its population listed as “suffering” than does the United States (3%).

The Ultimate Unhappiness Measure

The United States is on the second tier of nations in terms of national suicide rates (22nd overall). And we spend by and away the most on antidepressant medication.

How Well Does the Government Serve the People?

Government Indicators

Nearly every Internet site and alternative radio show focuses on America’s failing economy and the establishment of a banker run tyrannical government intent on depriving us of our personal freedoms. Unlike the corporate controlled media, the alternative media has identified the major facts on why Americans are living in a “fundamentally transformed”, soon-to-be third world country. These beliefs are validated by the following data.
At the conclusion of WWII, America, with only 5% of the population, controlled 50% of the World’s GDP. The American economy was number one for decades, but corporate greed coupled with the central bankers ability to legally bribe government officials with PAC money, established free trade agreements and whole host of corporate friendly policies at the expense of the disappearing American middle class.
The following statistics are dismal. People in Singapore have a more prosperous economy than do we in the United States. You are safer walking the streets of Hong Kong than you are in the US. The Irish, despite their long history of oppression, have more personal freedoms that do people in the United States.
When one examines the relative statistics of the G20 nations (i.e. the most influential 20 nations in the world), if it was not for our military prowess, we probably would not get invited to their meetings based upon the global  economic, citizen safety and personal freedoms, in the United States,  in comparison to our modern international cohorts.

7. Taiwan 7. Luxembourg 7. Denmark

9. Hong Kong 9. Canada 9. Netherlands
10. Australia 10. Switzerland 10. Iceland
…….20.  USA ……..27. USA …….20. USA
Didn’t George Bush tell us that the terrorists hate us for our freedoms? What freedoms? You mean that old Constitution that we have allowed our banker run government to throw on the trash heap of history?

Conclusion

It is true that America is not the worst nation on the face of the earth. However, in comparison most of the  developed nations, it is among the worst and slipping fast. America’s loss of status in the world is primarily due to the fact that America has been robbed blind by the bankers who have hijacked our nation. Sadly, the most of the American sheep are totally unaware that they have been enslaved by technocratic dictators. Americans are truly the quintessential frogs in the boiling pot.

$205 Trillion in Unfunded Liabilities: Information The Government Does Not Want You To Know

February 15th, 2014

(The Daily Rekoning) The nonpartisan Congressional Budget Office is acting in a bipartisan way to cover up the biggest single threat to the bipartisan political alliance that is stripping America of its wealth: the United States Congress.
There is no question that the following policy is bipartisan. Democrats and Republicans in Congress are completely agreed that the following information should not get out to the American people, namely, that the present value of the United States government’s off-budget liabilities is over $200 trillion.
…the government needs $205 trillion… to invest in the private sector, in order to fund its legal liabilities.
The man who has followed this for the longest time is Prof. Laurence Kotlikoff of Boston University. He has created a great deal of embarrassment for the government by his relentless pursuit of the statistical implications of the statistics released by the Congressional Budget Office.
The Congressional Budget Office has a way to avoid this, namely, to cease publishing the statistics that Kotlikoff has used to expose the real condition of the United States government.
Kotlikoff referred to this suppression of information in an article that appeared in Forbes.
The CBO has two sets of books. This is what any Ponzi scheme requires. It releases one set of books to the rubes in the financial media, who are perfectly content to quote from it, when they are even aware of it. This is called the Extended Baseline Forecast or EBF.
The second set of books is called the Alternative Fiscal Scenario or AFS. Here’s how Kotlikoff describes the difference.
In past years, the CBO simultaneously released what it calls its Alternative Fiscal Scenario. This forecast is what CBO actually projects future taxes and spending to be given not just the laws in place, but also how Congress and the Administration have been bending and changing the laws through time. In short, the Alternative Fiscal Scenario (AFS) is what the CBO thinks we’re facing absent a truly dramatic and sustained shift in fiscal policy.
Because of Kotlikoff’s ability to get news coverage for the AFS, the CBO decided this year not to publish it.
Those of us who track U.S. fiscal policy eagerly await each year’s release of the AFS. But this year, the CBO’s long-term forecast included only the EBF. The AFS was nowhere to be seen. It wasn’t mentioned in the CBO’s lengthy report. Nor was it included in the downloadable data CBO provided on its website.
The national media, which generally “covers” fiscal affairs by repeating what it’s told, missed this omission entirely. Indeed, it spent an entire news cycle discussing the EBF figures as if they had real meaning.
The CBO did not get away with this, at least not to the extent that it had hoped. There were complaints. Kotlikoff says that enough people did complain to persuade the CBO to release a summary of the projections in an obscure spot in the CBO’s spreadsheet. The CBO posted this information, but it did not alert the financial media to the update.
He predicted that the link would soon be removed. This was in early October.
The EBF and AFS projections differ dramatically, yet the AFS is hidden away in one tab of one spreadsheet called Supplementary Data, the small link to which will shortly disappear from the CBO’s homepage, making it even harder for we taxpayers to find.
He was correct. It’s gone. It’s “page not found.”
[Ed. Note: We tried accessing the link, but nothing came up.]
He points out that the CBO’s projections on the deficit which it has posted in full public view, namely, the ESB, has the fiscal gap at $47 trillion. Now, just between you and me, $47 trillion is a large chunk of change. But it is such a low-ball estimate that the public has no real conception of how big the liability really is. Of course, the public doesn’t care one way or the other, because the public has never heard of the CBO, let alone the ESB. When I say “public,” I mean the financial media.
Using the AFS figures, the unfunded liability is $205 trillion. This is the figure that the CBO does not want the general public, meaning the financial media, to be aware of.

HUGE Ruling Against Bank of America MERS bank foreclosure in Washington State (non-Judicial) - Judge: FORECLOSURES ILLEGAL/UNCONSTITUTIONAL! Give this information to your Lawyer!

Update 2/15/14 - I spoke to Scott Stafne about the ruling.  We will be getting together and taping a conversation this coming week.  I will put it up after we have done so.

This is HUGE RULING against Bank of America, a MERS bank in Washington State.

The judge ruled the BOA MERS foreclosure was not legal in anyway. He also set it up where the person foreclosed on can get monetary damages from BOA in a trial.

This information and ruling was in a non-judicial foreclosure state.

The attorney in Washington State who handles illegal foreclosures and who won this case is

Scott E. Stafne
Stafne Trumbull, LLC
239 North Olympic Avenue
Arlington, WA 98223
ph# 360-403-8700

The pdf of the Judges ruling is here.

portion from ruling:

There was no evidence that MERS was ever the owner or holder of the note. Hence,
under the Bain decision, MERS could not have been the beneficiary. Bain left open the issue of
whether MERS could act as an agent of the lender or trustee, and in support of its motion for
summary judgment defendants make that assertion here. More troubling is the role of
ReconTrust. It was ReconTrust which issued the notice of default to the borrower. ReconTrust
was not the trustee when that notice was issued. It’s undisputed that ReconTrust was, at all
times, a wholly owned subsidiary of BANA. There’s no reason, or at least none that I could see,
that would preclude ReconTrust from issuing a notice of default as an agent of BANA. But
thereafter MERS named ReconTrust as the trustee. Or perhaps ReconTrust named itself as the
trustee, since the signatory “G. Hernandez” was not an employee of MERS but rather was
employed by ReconTrust. While the DTA appears to have been amended and arguably might
permit a subsidiary to act as a trustee, the statutory requirement remains that the trustee be
independent and not beholden to the lender or borrower. Acting as an agent of BANA and being
a wholly owned subsidiary of BANA, it seems specious to attempt to argue that ReconTrust was
an independent trustee
I have a call to Stafne Trumbull this morning and have left a message, asking if I could speak with him a few minutes about the ruling and the implications and how this helps everyone throughout the U.S.  If I hear from him and am able to speak with him for a short interview I will upload it and put it on the blog.

Here is an interview with a woman who is intimately familiar with the case and what the implications are.

Big Bank FAIL - Judge rules BOA foreclosures unconstitutional

If you are in Foreclosure or at risk for a Foreclosure - PLEASE contact an attorney, your town/city legal aid and get this information to them!

DO NOT GET FORECLOSED ON!  STAND UP AND STAND FOR YOUR RIGHTS!  STAND FOR LEGAL JUSTICE!  STAND UP AGAINST THE ILLEGAL FORECLOSURES THAT ARE HAPPENING!

IF YOU HAVE ALREADY BEEN FORECLOSED ON - GET AN ATTORNEY AND FILE SUIT AGAINST THE BANK THAT FORECLOSED ON YOU!

START A MOVEMENT OF ALL PAST ILLEGAL FORECLOSURES HAVING TO GO TO COURT AND THE PEOPLE WINNING FOR LEGAL JUSTICE!
