Elite Intrigues and Military Purges: It’s Not About Sex, Stupid!

The headline stories claim that CIA Director General David Petraeus resigned as head of the CIA because of an adulterous relation with his young biographer and that General John Allen, Supreme Commander of US troops in Afghanistan, was under investigation and his promotion to top commander of US troops in Europe was on hold, because, we are told, of his ‘inappropriate’ comments in the exchange of e-mails with a civilian female friend.  We are told that a ‘hard-charging’ local FBI agent, Frederick Humphries, Jr., had uncovered amorous e-mails sent by General Petraeus to his girlfriend-biographer in the course of investigating a complaint of ‘cyber-stalking’.  Out of concern that the General’s ‘adulterous behavior’ posed a risk to US national security, Florida-based FBI Agent Humphries handed the evidence over to one of Washington, DC’s most powerful Republican, Congressman Eric Cantor, who in turn passed them on to the Director of the FBI… leading to Petraeus resignation.
In other words, we are asked to believe that a single, low-ranking, zealous FBI agent has toppled the careers of two top US Generals: one in charge of the principle global intelligence agency, the CIA, and the other in command of the US and allied combat forces in the principle theater of military engagement – on the basis of infidelity and flirtatious banter!
Nothing could be more far-fetched simply on prima facie evidence.
In the sphere of tight hierarchical organizations, like the military or the CIA, where the activity and behavior of subordinate functionaries is centrally directed and any investigation is subject to authorization by senior officials (most especially regarding prying into the private correspondences of the heads of the CIA and of strategic military operations), the idea that a lone agent might operate free-lance is preposterous.  A ‘cowboy’ agent could not simply initiate investigation into such ‘sensitive’ targets as the head of the CIA and a General in an active combat zone without the highest level authorization or a network of political operatives with a much bigger agenda.   This has much deeper political implications than uncovering a banal sexual affair between two consenting security-cleared adults despite the agent’s claim that fornication constitutes a threat to the United States .
Clearly we are in deep waters here:  This involves political intrigue at the highest level and has profound national security implications, involving the directorship of the CIA and clandestine operations, intelligence reports, multi-billion dollar expenditures and US efforts to stabilize client regimes and destabilize target regimes.  CIA intelligence reports identifying allies and enemies are critical to shaping global US foreign policy.  Any shift at the top of the US empire’s operational command can and does have strategic importance.
The ‘outing’ of General Allen, the military commander in charge of Afghanistan, the US main zone of military operations occurs at a crucial time, with the scheduled forced withdrawal of US combat troops and when the Afghan ‘sepoys’, the soldiers and officers of the puppet Karzai regime, are showing major signs of disaffection, is clearly a political move of the highest order.
What are the political issues behind the beheading of these two generals?  Who benefits and who loses?
At the global level, both Generals have been unflinching supporters of the US Empire, most especially the military-driven components of empire building.  Both continue to carry out and support the serial wars launched by Presidents Bush and Obama against Afghanistan and Iraq , as well as, the numerous proxy wars against Libya , Syria , Yemen , Somalia , etc.  But both Generals were known to have publicly taken positions unpopular with certain key factions of the US power elite.
CIA Director, General Petraeus has been a major supporter of the proxy wars in Libya and Syria .  In those efforts he has promoted a policy of collaboration with rightwing Islamist regimes and Islamist opposition movements, including training and arming Islamist fundamentalists in order to topple targeted, mostly secular, regimes in the Middle East .  In pursuit of this policy – Petraeus has had the backing of nearly the entire US political spectrum.  However, Petraeus was well aware that this ‘grand alliance’ between the US and the rightwing Islamist regimes and movements to secure imperial hegemony, would require re-calibrating US relations with Israel .  Petraeus viewed Netanyahu’s proposed war with Iran, his bloody land grabs in the Occupied Territories of Palestine and the bombing, dispossession and assassination of scores of Palestinians each month, were a liability as Washington sought support from the Islamist regimes in Egypt, Tunisia, Turkey, Afghanistan, Pakistan, the Gulf States, Iraq and Yemen.
Petraeus implied this in public statements and behind closed doors he advocated the withdrawal of US support for Israel ’s violent settler expansion into Palestine , even urging the Obama regime to pressure Netanyahu to reach some settlement with the pliable US client Abbas leadership.  Above all, Petraeus backed the violent jihadists in Libya and Syria while opposing an Israel-initiated war against Iran, which he implied, would polarize the entire Moslem world against the Washington-Tel Aviv alliance and ‘provoke the US-proxy supplied Islamist fundamentalists to turn their arms against their CIA patrons.  The imperial policy, according to General Petraeus world view, was in conflict with Israel ’s strategy of fomenting hostility among Islamist regimes and movements against the US and, especially, the Jewish state’s promotion of regional conflicts in order to mask and intensify its ethnic cleansing of the Palestinians.  Central to Israeli strategy and what posed the most immediate threat to the implementation of a Petraeus’ doctrine was the influence of the Zionist power configuration (ZPC) in and out of the US government.
As soon as General Petraeus’ report naming Israel as a ‘strategic liability’ became known, the ZPC sprang into action and forced Petraeus to retract his statements – at least publicly.  But once, he became head of the CIA, Petraeus continued the policy of working with rightwing Islamist regimes and arming and providing intelligence to jihadi fundamentalists in order to topple independent secular regimes, first in Libya, then on to Syria.  This policy was placed under the spotlight in Benghazi with the killing of the US ambassador to Libya and several CIA/Special Forces operatives by CIA-backed terrorists leading to a domestic political crisis, as key Republican Congress people sought to exploit the Obama administration’s diplomatic failure.  They especially targeted the US Ambassador to the UN, Susan Rice, whose maladroit efforts to obscure the real source of the attacks in Benghazi , have undermined her nomination to replace Hilary Clinton as Secretary of State.
General Petraeus, faced with mounting pressure from all sides: from the ZPC over his criticism of Israel and overtures to Islamist regimes, from the Republicans over the Benghazi debacle and from the FBI, over the personal investigation into his girlfriend and hyped up media smear, gave in.  He ‘fessed up’ to a ‘sexual affair’, saluted and resigned.  In so doing, he ‘sacrificed’ himself in order to ‘save the CIA’ and his strategy of long-term alliance-building with ‘moderate’ Islamist regimes while forming short-term tactical alliances with the jihadists to overthrow secular Arab regimes.
The key political operative behind the high-level FBI operation against Petraeus has been House Majority leader Eric Cantor, who cynically claims that the General’s romantic epistles represent a national security threat.  We are told that Congressman Cantor gravely passed the e-mails and reports he had received from the ‘Lone Ranger’ FBI agent Humphries to FBI Director Mueller ordering Mueller to act on the investigation or else face his own Congressional inquiry.
Washington-based Representative Cantor is a zealous lifetime Israel-firster and has been hostile to the Petraeus report and the General’s assessment of the Middle East .  Florida-based, Agent Humphries was not just any old conscientious gum-shoe:  He was a notorious Islamaphobe engaged in finding terrorists under every bed.  His claim to fame (or infamy) was that he had arrested two Muslims, one of whom, he claimed, was preparing to bomb the Los Angeles airport while the other allegedly planned a separate bombing.  In a judicial twist, unusual in this era of FBI sting operations, both men were acquitted of the plots for lack of evidence, although one was convicted for publishing an account of how to detonate a bomb with a child’s toy!  Agent Humphries was transferred from Washington State to Tampa , Florida – home of the US military’s Central Command (CENTCOM).
Despite their clear differences in station and location, there are ideological affinities between House Majority Whip Cantor and Agent Humphries – and possibly a common dislike of General Petraeus.  Concerns over his Islamophobic and ideological zealotry may explain why the FBI quickly yanked Agent Humphries out from his mission of ‘obsessive’ prying into CIA Director Petraeus and General Allan’s e-mails.  Undeterred by orders from his superiors in the FBI, Agent Humphries went directly to fellow zealot Congressman Cantor.
Who would have benefited from Petraeus ouster?  One of the top three candidates to replace him as head of the CIA is Jane Harmon, former California Congresswomen and Zionist uber-zealot.  In another twist of justice, in 2005 the Congresswoman had been captured on tape by the National Security Agency telling Israeli Embassy personnel that she would use her influence to aid two AIPAC officials who had confessed to handing classified US documents to the Israeli Mossad, if the AIPAC could round up enough Congressional votes to make her Chairwoman of the US House Committee on Intelligence, an act bordering on treason, for which she was never held to account.  If she were to take his position, the ousting of CIA Director Petraeus could represent to the greatest ‘constitutional coup’ in US history: the appointment of a foreign agent to control the world’s biggest, deadliest and richest spy agency.  Who would benefit from the fall of Petraeus? – first and foremost – the State of Israel.
The innuendos, smears and leaked investigation into the private e-mails of General Allen revolve around his raising questions over the US policy of prolonged military presence in Afghanistan .  From his own practical experience General Allen has recognized that the puppet Afghan army is unreliable: hundreds of US and other NATO troops have been killed or wounded by their Afghan counterparts, from lowest foot soldiers to the highest Afghan security officials, ‘native’ troops and officers that the US had supposedly trained for a much ballyhooed ‘transfer of command’ in 2014.  General Allen’s change of heart over the Afghan occupation was in response to the growing influence of the Taliban and other Islamist resistance supporters who had infiltrated the Afghan armed forces and now had near total control of the countryside and urban districts right up to the US and NATO bases.  Allen did not believe that a ‘residual force’ of US military trainers could survive, once the bulk of US troops pulled out.  In a word, he favored, after over a decade of a losing war, a policy of cutting the US ’ losses, declaring ‘victory’ and leaving to regroup on more favorable terrain.
Civilian militarists and neo-conservatives in the Executive and Congress refuse to acknowledge their shameful defeat with a full US retreat and a likely surrender to a Taliban regime.  On the other hand, they cannot openly reject the painfully realistic assessment of General Allen, and they certainly cannot dismiss the experience of the supreme commander of US ground forces in Afghanistan .
When, in this charged political context, the rabidly Islamaphobic FBI agent Humphries ‘stumbled upon’ the affectionate personal correspondences between General Allen and ‘socialite’ femme fatale Jill Kelly, the Neocons and civilian militarists whipped up a smear campaign through the yellow journalists at the Washington Post, New York Times and Wall Street Journal implying another ‘sex’ scandal – this time involving General Allen. The neo-con– militarist-mass media clamor forced the spineless President Obama and the military high command to announce an investigation of General Allen and postpone Congressional hearings on his appointment to head the US forces in Europe .  While the General quietly retains his supreme command of US forces in Afghanistan , he has become a defeated and disgraced officer and his expertise and professional views regarding the future of US operations in Afghanistan will no longer be taken seriously.
Key Unanswered Questions Surrounding Elite Intrigues and Military Purges
Given that the public version of a lone-wolf, low ranking, zealously Islamophobic and incompetent FBI agent who just happened to ‘discover’ a sex scandal leading to the discrediting or resignation of two of the US highest military and intelligence officials is absurd to any thinking American, several key political questions with profound implications for the US political system need to be addressed.  These include:
1.       What political officials, if any, authorized the FBI, a domestic security agency to investigate and force the resignation of the Director of the CIA?
2.       Have the current police state structures, with their procedures for widespread and arbitrary spying led to our spy agencies spying on each other in order to purge each other’s top personnel?  Is this like the sow devouring her own offspring?
3.      What were the real priorities of the political power-brokers who protected the insubordinate FBI agent Humphries after he defied top FBI officials’ orders to stop meddling in the investigation of the CIA Director?
4.      What were FBI Agent Humphries ties, if any, to the neo-con, Zionist or Islamophobic politicians and other intelligence operatives, including the Israeli Mossad?
5.      Despite Obama’s effusive praise of his brilliant ‘warrior-scholar’ General Petraeus in the past, why did he immediately ‘accept’ (aka ‘force’) the CIA Director’s resignation after the revelation of something as banal in civilian life as adultery?  What are the deeper political issues that led to the pre-emptive purge?
6.      Why are critical political issues and policy disputes resolved under the guise of blackmail, smears and character assassination, rather than through open debates and discussions, especially on matters pertaining to the nation’s choice of strategic and tactical ‘allies’ and the conduct of overseas wars?
7.      Has the purge and public humiliation of top US military officers become an acceptable form of “punishment by example”, a signal from civilian militarists that when it comes to dealing with politics toward the Middle East, the role of the military is not to question but to follow their (and Israel’s) directives?
8.      How could a proven collaborator with the Israeli-Mossad and Zionist zealot like Jane Harmon emerge as a ‘leading candidate’ to replace General Petraeus, as Director of the CIA, within days of his resignation?  What are the political links, past and present between Congressman Eric Cantor, (the fanatical leader of the pro-Israel power bloc in the US Congress, who handed Agent Humphries’ unauthorized files on Petraeus over to the FBI Director Muellar) and Zionist power broker Jane Harmon, a prominent candidate to replace Petraeus?
9.       How will the ouster of Director Petraeus and Jane Harman’s possible appointment to head the CIA deepen Israeli influence and control of US Middle East policy and the US overtures to Islamist countries?
10.  How will the humiliation of General Allen affect the US ‘withdrawal’ from the disaster in Afghanistan ?
Conclusion
The purge of top-level generals and officials from powerful US foreign policy and military posts reflects a further decay of our constitutional rights and residual democratic procedures: it is powerful proof of the inability of leadership at the highest level to resolve internecine conflicts without drawing out the ‘long knives’.  The advance of the police state, where spy agencies have vastly expanded their political power over the citizens, has now evolved into the policing and purging of each other’s leadership:  the FBI, CIA , Homeland Security, the NSA and the military all reach out and build alliances with the mass media, civilian executive and congressional officials as well as powerful foreign interest ‘lobbies’ to gain power and leverage in pursuit of their own visions of empire building.
The purge of General Petraeus and humiliation of General Allen is a victory for the civilian militarists who are unconditional supporters of Israel and therefore oppose any opening to ‘moderate’ Islamist regimes. They want a long-term and expanded US military presence in Afghanistan and elsewhere.
The real precipitating factor for this ugly ‘fight at the top’ is the crumbling of the US empire and how to deal with its new challenges.  Signs of decay are everywhere:  Military immorality is rampant; the be-medaled generals sodomize their subordinates and amass wealth via pillage of the public treasury and military contracts; politicians are bought and sold by millionaire financial donors, including agents of foreign powers, and foreign interests determine critical US foreign policy.
The disrepute of the US Congress is almost universal – over 87% of US citizen condemn ‘the House and Senate’ as harmful to public welfare, servants of their own self-enrichment and slaves of corruption.  The economic elites are repeatedly involved in massive swindles of retail investors, mortgage holders and each other.  Multi-national corporations and the fabulously wealthy engage in capital flight, fattening their overseas accounts.  The Executive himself (the ever-smiling President Obama) sends clandestine death squads and mercenary-terrorists to assassinate adversaries in an effort to compensate for his incapacity to defend the empire with diplomacy or traditional military ground forces or to prop-up new client-states.  Cronyism is rife: there is a revolving door between Wall Street and US Treasury and Pentagon officials.  Public apathy and cynicism is rife; nearly 50% of the electorate doesn’t even vote in Presidential elections and, among those who do vote, over 80% don’t expect their elected officials to honor  their promises.
Aggressive civilian militarists have gained control of key posts and are increasingly free of any constitutional constraints.  Meanwhile the costs of military failures and burgeoning spy, security and military budgets soar while the fiscal and trade deficit grows.  Faction fights among rival imperial cliques intensify; purges, blackmail, sex scandals and immorality in high places have become the norm.  Democratic discourses are hollowed out:  democratic state ideology has lost credibility.  No sensible American believes in it anymore.
Is there a broom large enough to clean this filthy Augean stable?  Will a ‘collective Hercules’ emerge from all this intrigue and corruption with the strength of character and commitment to lead the revolutionary charge?  Surely the sell-out and crude humiliation of American military officials on behalf of the ‘chicken-hawk’ civilian militarists and their foreign interests should make many an officer re-think his own career, loyalty and commitment to the Constitution.

Scientists working on NASA's six-wheeled rover on Mars have a problem. But it's a good problem.
They have some exciting new results from one of the rover's instruments. On the one hand, they'd like to tell everybody what they found, but on the other, they have to wait because they want to make sure their results are not just some fluke or error in their instrument.
It's a bind scientists frequently find themselves in, because by their nature, scientists like to share their results. At the same time, they're cautious because no one likes to make a big announcement and then have to say "never mind."
The exciting results are coming from an instrument in the rover called SAM. "We're getting data from SAM as we sit here and speak, and the data looks really interesting," John Grotzinger, the principal investigator for the rover mission, says during my visit last week to his office at NASA's Jet Propulsion Laboratory in Pasadena, Calif. That's where data from SAM first arrive on Earth. "The science team is busily chewing away on it as it comes down," says Grotzinger.
SAM is a kind of miniature chemistry lab. Put a sample of Martian soil or rock or even air inside SAM, and it will tell you what the sample is made of.
Grotzinger says they recently put a soil sample in SAM, and the analysis shows something earthshaking. "This data is gonna be one for the history books. It's looking really good," he says.
Grotzinger can see the pained look on my face as I wait, hoping he'll tell me what the heck he's found, but he's not providing any more information.
So why doesn't Grotzinger want to share his exciting news? The main reason is caution. Grotzinger and his team were almost stung once before. When SAM analyzed an air sample, it looked like there was methane in it, and at least here on Earth, some methane comes from living organisms.
But Grotzinger says they held up announcing the finding because they wanted to be sure they were measuring Martian air, and not air brought along from the rover's launchpad at Cape Canaveral.
"We knew from the very beginning that we had this risk of having brought air from Florida. And we needed to diminish it and then make the measurement again," he says. And when they made the measurement again, the signs of methane disappeared.
Grotzinger says it will take several weeks before he and his team are ready to talk about their latest finding. In the meantime he'll fend off requests from pesky reporters, and probably from NASA brass as well. Like any big institution, NASA would love to trumpet a major finding, especially at a time when budget decisions are being made. Nothing succeeds like success, as the saying goes.
Richard Zare, a chemist at Stanford University, appreciates the uncomfortable position John Grotzinger is in. He's been there. In 1996, he was part of a team that reported finding organic compounds in a meteorite from Mars that landed in Antarctica. When the news came out, it caused a huge sensation because finding organic compounds in a Martian rock suggested the possibility at least that there was once life on Mars.
"You're bursting with a feeling that you want to share this information, and it's frustrating when you feel you can't talk about it, "says Zare.
It wasn't scientific caution that kept Zare from announcing his results. It was a rule many scientific journals enforce that says scientists are not allowed to talk about their research until the day it's officially published. Zare had to follow the rules if he wanted his paper to come out.
He did break down and tell his family. "I remember at the dinner table with great excitement explaining to my wife, Susan, and my daughter, Bethany, what it was we were doing," says Zare. And then he experienced something many parents can relate to when talking to their kids.
"Bethany looked at me and said, 'pass the ketchup.' So, not everybody was as excited as I was," he says.
Zare says in a way, scientists are like artists. Sharing what they do is a big part of why they get out of bed in the morning.
"How many composers would actually compose music if they were told no one else could listen to their compositions? How many painters would make a painting if they were told no one else could see them?" says Zare. It's the same for scientists. "The great joy of science is to be able to share it. And so you want to say, 'Isn't this interesting? Isn't that cool?' "
For now, though, we'll have to wait to see what's got Mars rover scientists itching to say what they found.

“Chemtrails” rain aluminum nanoparticles on man, beast, and land.

The name chemtrails is a spin-off from contrails, which are condensation trails left behind flying aircraft. There is credible evidence that chemtrails are toxic to man, animals, and the soil.
There is current concern in the United States about the increasing number of neurodegenerative patients. Since 2000, the number of Alzheimer’s patients has increased from 4.5 million to 5.4 million in 2012, according to the Alzheimer’s Association. One in eight people 65 or older have Alzheimer’s. A yearly increase seems inevitable because of the aging population, but environmental factors also play a role.
The article, “Chemtrails, Nano-aluminum, and Neurodegenerative and Neurodevelopmental Effects” by Russell Blaylock, M.D., in the National Health Federation magazine “Health Freedom News” warns against one of these environmental hazards: chemtrails.
Blaylock, who has retired from neurosurgery to do research, write, and teach, began to notice chemtrails a few years ago and writes, “Of particular concern is that there are now so many—dozens every day are littering the skies.” Chemtrails are made from aerosols, usually spread by non-passenger jets. What at first looks like contrails turns into ribbons of clouds that spread out making the sky look over-cast. They contain various toxic, and biological substances. Blaylock concentrates on the effects of the nano-aluminum particles, as mentioned in Part 2 of Chemtrails Over Las Vegas in the August 26, 2005, Las Vegas Tribune.

Chemtrails are not admitted as a threat or as existing by governments, but their existence occasionally comes out in the media. TV station KNBC Los Angeles, Calif. hosted Toxic Sky with Paul Moyer, an account of sickness of children and record amounts of barium and aluminum in the water supply after chemtrails were seen over San Bernardino.
In Aug. 2005 the Las Vegas Tribune had a two-part article detailing the chemtrails over Las Vegas, the ensuing chemtrails sickness, and previous chemtrail history from other sources. In the Las Vegas Tribune report, the U.S. Air Force on their website called chemtrails a “chemtrail hoax,” but “scientists working at Wright Patterson Air Force Base confirmed to the Ohio newspaper, Columbus Alive, that they were involved in aerial spraying experiments. One involved aluminum oxide spraying related to global warming and the other involved barium stearate and had to do with high-tech military communications.”
Individuals who have noticed health problems, die-off of livestock or crops concurrently with the appearance of chemtrails have investigated on their own, having their blood, soil, water, and atmosphere tests made to compare with the norms. A compendium of these reports both documented and anecdotal is on Strange Days Strange Skies online.
The documentary film What in the World Are They Spraying? produced by G. Edward Griffin, Michael Murphy, and Paul Wittenberger shows the impact on the environment of chemtrails. For instance, the snow on Mount Shasta normally has 7 parts per billion (ppb) of aluminum, but over the last four or five years it has increased to 61,000 ppb.
Soil in northern California is turning alkaline, disrupting the root systems of trees. Farmers have noted that some plants will no longer grow in Hawaii. Fishermen see fewer bugs for the fish. These are a few examples from the above documentary.
True to his specialty, Blaylock chooses to write about the neurotoxin nano-aluminum, one of the main ingredients of today’s chemtrails. He states in his article that “studies have shown that these particles pass along the olfactory neural tracts, which connect directly to the area of the brain that is not only most affected by Alzheimer’s disease, but also the earliest affected in the course of the disease.”
Aluminum nanoparticles are also very easily absorbed from the GI tract, unlike ordinary aluminum that is usually not absorbed. Because of their small size, the nanoparticles can go through the brain-blood barrier, penetrate cell membranes, and disrupt mitochondria.
Nanoparticles can accumulate in the bone marrow, spleen, lymph nodes, and heart, as reported in “Manufactured Aluminum Oxide Nanoparticles Decrease Expression of Tight Junction Proteins in Brain Vasculature,” published in the Journal of Neuroimmune Pharmacology (December 2008). Not happy with building mysterious gigantic structures in the desert, the Chinese are now building inter-dimensional portals in the middle of their cities. I mean, come on, what the hell is this 157m high metal structure in the the city of Fushun, in northeast China’s Liaoning province?
It’s made of an astounding 3000 tons of steel and it will glow at night — decorated with 12,000 LED lights. According to Fushun Municipal Government’s officials, this titanic structure does absolutely nothing except serve as an elevated sighting position. They claim it is pretty “landscape architecture” — like the Eiffel Tower. It uses four elevators to take people to the top.
The Chinese media has been harsh about the building after a blogger posted these photos on Sina Weibo, which is the country’s “largest microblog platform”. Not surprising, since this thing costs $US16 million.
According to Fushun’s Urban Construction Bureau, the “Ring of Life” means “a round sky and a path leading to a paradise in heaven.”

NAMIBIAN media report a strange muppet-like beast has been shot dead after a group stumbled across several of the creatures in dense jungle.
Locals came across the bizarre being while they were escorting a shooting party in Namibia, local media reported.
Witnesses state that the creature was spotted apparently foraging for food, one of the shooting party wounded it with his rifle and it escaped into the thick brush.
The locals tracked it to a nearby lair or nest where they found three more creatures of similar size.
The wounded creature attacked one of the shooting party and it was shot dead, the others escaped into the brush
The body of the creature was taken back to the local camp, police later removed its corpse and a full forensics investigation is under way

We've been pointing out for a while that one of the reasons why advancements in 3D printing have been relatively slow is because of patents holding back the market. However, a bunch of key patents have started expiring, leading to new opportunities. One, in particular, that has received a fair bit of attention was the Formlabs 3D printer, which raised nearly $3 million on Kickstarter earlier this year. It got a ton of well-deserved attention for being one of the first "low end" (sub ~$3,000) 3D printers with very impressive quality levels.
Part of the reason the company said it could offer such a high quality printer at a such a low price, relative to competitors, was because some of the key patents had expired, allowing it to build key components without having to pay astronomical licensing fees. A company called 3D Systems, however, claims that Formlabs missed one patent. It holds US Patent 5,597,520 on a "Simultaneous multiple layer curing in stereolithography." While I find it ridiculous that 3D Systems is going legal, rather than competing in the marketplace, it's entirely possible that the patent is valid. It just highlights how the system holds back competition that drives important innovation, though.

3D Systems claims that Formlabs "took deliberate acts to avoid learning" about 3D Systems' live patents. The lawsuit claims that Formlabs looked only for expired patents -- which seems like a very odd claim. Why would they only seek expired patents? Either way, the lawsuit claims that all of the articles that highlighted how the expiration of patents made Formlabs' printer possible meant that Formlabs must have known about its patents. Again, not quite sure the reasoning makes much sense here.

But what's really crazy is that 3D Systems isn't just going after Formlabs... but Kickstarter as well. You can read the whole filing here. 3D Systems is claiming that because Kickstarter takes a cut, it's equally liable.
Upon information and belief, Formlabs and it sales agent Kickstarter knew or should have known about, or were willfully blind to, 3D Systems' extensive patent rights in the area of three-dimensional printing and stereolithography, including but not limited to 3D Systems' U.S. Patent No. 5,597,520 covering improved methods of stereolithographically forming a three-dimensional object by forming cross-sectional layers of an object from a material capable of physical transformation upon exposure to synergistic stimulation, by virtue of their sales of machines touted by Formlabs as using "stereolithography (SL) technology," which is a technology invented and extensively patented by 3D Systems and its founder Charles Hull.
The accusations against Kickstarter are really ridiculous -- suggesting that it encouraged infringement:
Upon information and belief, Kickstarter contributes to the infringement of the '520 Patent by offering to sell and selling within the United States the Form 1 3D printer which is an apparatus for use in practicing patented processes of the '520 Patent, constituting a material part of the invention, knowing the same to be especially made or especially adapted for use in an infringement of the '520 Patent, and the Form 1 3D Printer is not a staple article or commodity of commerce suitable for substantial noninfringing use.

Upon information and belief, Kickstarter knowingly or with willful blindness induced and continues to induce infringement and possessed specific intent to encourage another's infringement by, or was willfully blind as to the '520 Patent and with respect to, its activities and Formlabs' activities described above.
Most bizarre of all? 3D Systems claims that because Kickstarter encourages "hacker and maker" projects, it's knowingly encouraging infringement -- as if "hackers and makers" are only about infringement. This is a really cynical attempt to tie those words to a negative connotation where clearly none is meant.
Upon information and belief, Kickstarter had specific intent to infringe the '520 Patent by virtue of its agency, business and sales arrangement with Formlabs, which had actual knowledge of the '520 Patent and/or was willfully blind to the existence of the '520 Patent as set forth in the allegations above.

Indeed, in Kickstarter's own Guidelines as to "Project must fit Kickstarter's categories" at http://www.kickstarter.com/help/guidelines?ref=footer, under section 02, under "View Design and Technology requirements," Kickstarter is actively encouraging "hacker and maker" companies to make 3D printers for Kickstarter to sell, stating: "Not everything that involves design or technology is permitted on Kickstarter. While there is some subjectivity in these rules, we’ve adopted them to maintain our focus on creative projects: D.I.Y. We love projects from the hacker and maker communities (weekend experiments, 3D printers, CNC machines) and projects that are open source. Software projects should be run by the developers themselves."
I've read those paragraphs over a few times and I still can't see what the issue is there. How is supporting hackers and makers somehow evidence of "intent to infringe"?

Either way, 3D Systems has now permanently placed itself into the category of companies not worth ever doing business with. Suing Kickstarter just because a competitor was selling a better, cheaper 3D printer and you got jealous? Shameful.

Since the GOP decided to chicken out on holding the very necessary debate on copyright reform, let's keep the debate going without them, and hope they join in. As we've discussed, the Republican Study Committee released a fantastic report from staffer Derek Khanna, and then retracted it under lobbyist pressure. The RSC wants to claim that the paper didn't go through its full review process, but we've heard from multiple sources that this is simply not true, and that the RSC is pushing this story to appease angry lobbyists (apparently the US Chamber of Commerce has taken over as the leader of the cause on this one, following the initial complaints from the MPAA and RIAA). Either way, all this has done is draw much more attention to the report, which you can still read here.

But, clearly, some in Congress realize this is a debate worth having. So if they're too afraid of some industry lobbyists, we might as well kick off that debate for them. We're going to do a series of posts digging into Khanna's paper. The paper, of course, starts off by debunking three commonly believed myths concerning copyright law, which are often used by policy makers to justify bad policies.
The purpose of copyright is to compensate the creator of the content: It's a common misperception that the Constitution enables our current legal regime of copyright protection -- in fact, it does not. The Constitution's clause on Copyright and patents states:
"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries" (Article I, Section 8, Clause 8)
Thus, according to the Constitution, the overriding purpose of the copyright system is to "promote the progress of science and useful arts." In today's terminology we may say that the purpose is to lead to maximum productivity and innovation.
This is exactly correct, as we've discussed numerous times before. This is not to say that one of the results of copyright law is to compensate the creator. That's clearly a large part of how the law is supposed to function. The thinking behind this is not too complicated: if we can ensure greater compensation through limiting competition and supply via artificial monopolies, it drives up the price of those goods, leading to greater income.

But that theory includes several assumptions which may not be true. Let me present a hypothetical to make the point. I am not saying this is absolutely the case, but let's say we have scenario A and scenario B:
Scenario A
Artist's works are locked up under copyright, but he sells them for $1 per song downloaded.
Fans pay for and download 100 songs.

Scenario B
Artist frees up his work to the public domain, and encourages them to be spread freely. Thousands of copies of the song are downloaded. Artist sets up a Kickstarter to fund next batch of songs, and quickly raises $10,000
Again, I'm not saying that this is what happens in all cases. I'm just making this point: I don't believe that a single, sane person would argue that scenario A is better than scenario B. In scenario B the artist has more fans, more ability to make new music and more money. It's a much better position. But that income does not rely on copyright.

And that's the simple point that seems to get lost in this debate. Because copyright exists and is so prominent in the business model of artists, many incorrectly believe that it is the business model for content creators, and there can be no other. But, what we've really done is set up a crutch. Because the government has "picked winners and losers" by backing copyright as the core piece of a business model, most content creators have focused almost exclusively on monetizing via copyright. And thus, they argue, any attempt to change copyright is an attack on their incomes.

But, if we all agree that scenario B is a better scenario for the artist and for the consumer, then we've already shown that copyright, itself, may not be the best tool for artists seeking to make a living. I'm not saying that it absolutely isn't -- but that we have little evidence that copyright is actually the best such tool, and plenty of evidence that it can stifle and limit speech and creativity along the way.

There are many ways to make revenue as an artist. The Future of Music Coalition's Artist Revenue Streams worked out 42 different revenue streams for artists. Certainly, many of them rely on copyright, but a significant number do not. But content creators rarely get the chance to fully explore those other methods, because they're so wed to the idea that copyright is it.

Either way, if the idea is to maximize artist revenue, then we should be looking at what actually does that -- what actually results in greater artist revenue? Because there is no evidence that expanding copyright law seems to have that impact.

So all Khanna and the Republican Study Committee (briefly) were saying, was that the purpose of copyright law is to benefit "the progress of science and the useful arts." Part of that certainly may be to help artists make money, but that is not the ultimate goal, nor would it be reasonable as the ultimate goal. If we want to maximize artist revenue, let's explore that issue, but just assuming that's the goal of copyright is clearly faulty, leading to a very distorted market.

NASA scientists have found the crash site, pictured above, of a spacecraft set into orbit during the early 60s. This one–thankfully–is not crawling with Decepticons. They believe it is the missing Lunar Orbiter 2 which disappeared back in 1967 during a passage over the far side of the moon, when the craft went out of telescope and radio range.
Lunar Orbit 2′s primary function was documenting areas of the moon that would be most hospitable to the Apollo and Surveyor missions. During its run, it returned a total of 609 high resolution images and 208 medium-sized frames. This includes the Copernicus crater (pictured below) which is considered by many to be the Picture of the Century.

While the spacecraft was intentionally downed on October 11, 1967, scientists had yet to find the crash site–til now.
The wreckage is thought to have been located by the Lunar Reconnaissance Orbiter (LRO) which is currently mapping the lunar surface in unprecedented detail. During its mission so far, the spacecraft has gathered more than 192 terabytes of data; that’s nearly 41,000 DVDs worth of data, images and maps! One of its key findings is our solar system’s coldest spot: a crater near the moon’s north pole was recorded at minus 415 degrees Fahrenheit. Brrr!

During Assistant Director Jeff Meuse’s exhibiting of traveling displays from the International Cryptozoology Museum in New York City, he visited the Rubin Museum of Art. While there, he discovered intriguing imagery on a cloth painting.

Playing a “Where’s Waldo” game, Meuse and his assistant, the ICM’s coordinator of special events, searched the entire Himalayan art museum looking for signs of Yetis. Finally, he found one example.

The painting was dated to the 19th century from Mongolia.
The imagery is said to be “a depiction of the universe,” showing Mount Meru.
Mount Meru is a sacred mountain in Hindu, a giant location with several mystical, mythical, and heavenly aspects. A handful of western scholars have identified Mount Meru with the Pamirs, northeast of Kashmir, according to these sources.
In a corner of the Rubin’s Mount Meru painting is shown some Yetis.

For an artist who has worked tirelessly to maintain his artistic integrity (even going so far as to change his name/wear a mask), Prince has done more than most to ensure that his vision remains intact all the way up to the fans' ears. Unfortunately, he seems to view this "connection" with his fans as one-way.

Between starting one of the first CwF websites and swiftly abandoning it after collecting $79/head, suing YouTube, eBay and the Pirate Bay for "making his work available," declaring the internet to be "over" (and thus, unworthy of hosting his music) and claiming that cover versions physically destroy the original tunes (???), Prince has done everything he can to prevent fans from connecting with him.

To that end, Prince has yet again flexed his tiny, presumably purple, muscles to order a fan to cease and desist doing fan-type stuff. Troy Gua, a "serious Prince obsessive" and conceptual artist, just received a cease and desist letter from "Prince's people", ordering him to knock off his puppet-based adoration of the Artist.
Somewhere deep down, we're sure Troy Gua expected he'd someday have to face saying goodbye to the much-lauded miniature doll that was at the center of his art series, Le Petit Prince. This was no small project -- Gua literally recreated many famous Prince moments with the little guy and even included detailed props like the Purple Rain motorcycle. Ironically, we were recently emailing with Gua to do a piece about the new calendar he was putting out featuring some of these photographs, but this week Gua sadly informed us the dream is over. He received a cease and desist letter from the real Prince's people on Monday.
Not only did Troy Gua receive an angry email, but also a very official hard copy via FedEx. The order states that Gua is not allowed to "exhibit the photo work or the sculptural doll," which covers pretty much the entire Le Petite Prince project. Gua has decided not to fight back and has left instructions on his website asking fans to only leave positive comments.

Gua's taking the high road, but Prince seems unwilling to allow any sort of expression based on him or his works to see the light of day anywhere. CityPages points out that another artist was hit with a C&D for posting Prince remixes for streaming only at her SoundCloud page. Presumably, the upcoming calendar would be considered commercial use of Prince's image (I suppose) and that may have urged on the Purple Hammer, but DJ Lenka Paris' mixes weren't being sold or made available for download, so it's not entirely a crackdown on commercial use.

It may be that Prince wants all things "Prince" to originate from Prince only. If so, Prince should learn to let go. No one has that much control and attempting to maintain "artistic integrity" by stomping out anything not officially blessed by the man himself is an awful way to treat fans. Here's exactly how to do CwF WRONG:
If it wasn't clear before, his Purpleness has some very stringent ideas around what his fans can and cannot do in their appreciation of him. In a nutshell: Yes, please do pay $250 for that concert ticket, but 'Hova help you if you seek to publicly admire him through music or art.
Prince has a large fan base and it appears that his fans won't fight a legal battle with a.) someone with much more money or b.) someone they respect greatly, even if that respect is completely one way. One of those is logical and the other is understandable, but either way, it's tough for non-Prince-acolytes to respect an artist whose response to fan efforts that stray into "his" territory is unvarying legal thuggery.

Rarely do I blog about my personal feelings, or reactions, on this site, but a number of circumstances prompt me to share them. Within days of the last (s)election, two friends, each from one of the two political parties, asked me how I voted. Now, for one thing, I’ve made my sentiments and opinions of these “two” corrupt party machines well known: NO CONFIDENCE. But rather than trying to explain that to my friends, and that it is really a POSITIVE exercise of the vote, I was treated to the same old saw: “If you don’t vote, you have no right to complain.”
I had to remind my friends that the Bill of Rights recognizes that the rights of man are from God, they are not given by governments, nor can they be retracted by governments, nor can they be abrogated when individuals, such as myself, view the system as so corrupted that to participate in it is to contribute to the corruption.We had a “choice” between a candidate so weak anyone could have beat him, and a candidate too weak to beat anyone. This is what 150 years of Republithuggery and Dummycrookery have come to: an agreed upon detente of rot and corruption.
But in a way, I cannot blame my friends, for consider the extension of the American “standardized computerized tests,” with their pre-selected answers, to the current ballot: we have pre-selected “answers,” (candidates), from a narrow range of elite-approved answers (parties), and no option to explain our views in an essay in response to a question. We have been conditioned to such responses even by the polls. I remember, years ago, responding to a telephone political survey of the same nature: I was presented a preselected set of choices, none of which I could agree to.
This year, there are some interesting numbers, and these are the numbers they don’t want to talk about:
Now, I am far from assuming that the non-voting population – those eligible to vote, but who did not, for whatever reason – did not vote en masse out of the desire to send a no confidence vote to the likes of Lanny Davis, Chris Matthews, Karl Rove, Sean Hannity, Rush Limbaugh and Dick Morrison. But I’ll wager that some of them did, and that it was a significant number.Moreover, I’ll bet that of those disenfranchised Ron Paul supporters who did not hold their nose and vote for Barmitt Obromneyack (of either brand name), or for the Libertarian Party candidate Gary Johnson, that a significant number stayed home. Others, like a friend of mine, decided upon his own version of the no confidence vote, by voting for candidates or issues that he could in good conscience, and leaving the presidential “choice” (Barmitt Obromneyack, just to remind you), blank(a fitting irony in that perhaps, since that is what they were and are: blanks).
Which raises the question: why don’t the talking babbling buffoons on the left and the right in this country, who defend their respective brand names with a religious fervor (and corresponding blindness), or why don’t the Frank Luntz focus groups, ever talk about, much less to, that group of people? Do they even know they exist?(probably not) And if they do know they exist, why do they never ask the disenfranchised Democrat (I know a few, my late parents among them), or Republican(I am one), why we will never darken your party doorsteps again? The answers you learn just may save your party bacon the next time around.  Continue to do as you have been doing, however, and the vote of no confidence will only continue to grow, for right now, as one talking head has already begun his  hyperbolic “countdown” of mutually recognized Great Americans to the next election (which will be, incidentally, just like the last one, the most important election in our lifetimes), others continue to point out the abysmal track records of these “two” political parties, and their long list of broken promises, and will continue to say “No Confidence!”  One day, hopefully, you’ll hold another “two party election,” and the turnout will be so small you’ll both be exposed for the unprincipled frauds you really are. And take heart, you’re already trending in that direction.
